ExpertWitnessConsulting.org (EWC) maintains a database of expert witnesses and litigation consultants that we refer to attorneys. Attorneys nor their clients pay a fee for the referrals. Experts and litigation consultants pay a reasonable one-time fee only after they are retained and a deposit is received. Attorneys and their clients receive the advantage of substantially lower costs with no hourly markup. Experts and litigation consultants receive the advantage of paying a one-time fee, with no hourly markup, only after they have a new client and payment is received by them.

After selecting a referred expert witness or litigation consultant, attorneys are generally required to send a $3,500 deposit to EWC. The attorney and client receive a full credit for the deposit. EWC deducts its fee and sends the balance to the expert witness or litigation consultant. Our fee per case is always $1,500 which is earned when the expert witness or litigation consultant is accepted and the deposit is received.

To Prospective Expert Witnesses and Litigation Consultant Clients

If you are an expert witness or litigation consultant and would like to be considered to be added to our database, please complete an application and send it to us with a copy of any CV that you would like us to provide to prospective clients.

Our database of mediators is currently full so we are not currently accepting new applications for mediators.

Our Agreement with Experts and Litigation Consultants

  • Upon an attorney (Attorney) hiring an expert witness or litigation consultant (Expert) referred by EWC, the Attorney agrees to the following
  • Attorney shall provide EWC with a deposit of $3,500 within five days. Attorney and his or her client shall receive full credit with the Expert for the $3,500 paid.
  • The Expert or Litigation Consultant shall compensate EWC $1,500 from the deposit upon receipt of the deposit by EWC. No further compensation shall be payable to EWC.
  • All future bills for expert witness or litigation consulting services shall be sent directly to the Attorney by the Expert or Litigation Consultant for direct payment.
  • Attorney shall have no obligation to pay a fee to EWC for utilizing the services of an Expert or Consultant referred by EWC for any subsequent cases in which that Expert or Consultant provides services to the Attorney.
  • Attorney is fully responsible for determining the suitability of any Expert Witness or Litigation Consultant referred to Attorney by EWC.

 

Example of Transaction

Assume:

  • Attorney pays $3,500 to EWC.
  • Expert receives $2,000.
  • EWC receives $1,500 as full payment.
  • The Attorney receives 8.75 hours of time.
  • Expert's standard compensation rate is $400 per hour (example only)
  • $3,500 would normally cover 8.75 hours of time.
  • $2,000 received by Expert or Consultant equals $228.57 per hour for the first 8.75 hours
  • Thereafter, the Expert or Consultant is paid his or her standard rate of $400 per hour.

 

 

We believe the receipt of a reduced fee of $228.57 per hour for the first 8.75 hours is a small price for an Expert or Litigation Consultant to pay for a new Attorney client that may be a repeat client. Annualized, $228.57 per hour equals $475,425 per year. ($228.57 x 2080 hours)

Special Searches for Experts and Consultants

Sometimes attorneys need experts or consultants with unique qualifications that require special searches. EWC conducts special searches for hard to find experts and consultants at no cost to attorneys There is no fee payable unless the attorney engages a referred expert or consultant. Our Clients Evaluate Our Service

In order to constantly improve our services, we have implemented an Evaluation Program. At the end of each case, we request that each attorney complete a short evaluation form that we use to make future decisions about our referral business.
